Disclaimer & Compliance Policy

At Pool Safety Warehouse, we design and manufacture high-quality, factory-direct products to help you achieve pool barrier compliance. However, because pool safety is a regulated legal matter in Australia, please read the following terms regarding the use, installation, and compliance of our products.

1. Compliance with Australian Standards (AS 1926.1)

  • Design Standards: All of our pool safety barrier products are designed and fabricated in accordance with the dimensional and geometric specifications outlined in Australian Standard AS 1926.1 (Safety barriers for swimming pools).

  • Material Integrity: We use premium, UV-stabilised, commercial-grade plastics sourced and processed through our local Australian fabrication partners to ensure long-lasting structural performance under harsh local conditions.

2. The DIY Installation Disclaimer

While our products are designed to meet standard compliance rules, the ultimate compliance of your pool barrier depends entirely on correct installation.

  • Customer Responsibility: Pool Safety Warehouse provides the hardware, but we do not install it. It is the buyer’s sole responsibility to ensure that any DIY product is installed in the correct location, at the correct height, and secured using appropriate, sturdy fasteners as required by your local regulations.

  • No Modification Liability: We are not liable for any product failures, cracks, or structural degradation caused by incorrect installation, over-tightened fasteners, or unauthorised physical modifications made to the products (such as drilling additional holes or cutting the plastic yourself).

3. Independent Inspection & Certification

  • Final Approval: Purchasing or installing our products does not automatically guarantee that your pool area will pass inspection.

  • Local Regulations: Pool safety laws vary slightly between different Australian states and local council territories. It is your sole responsibility to have your completed pool barrier assessed and certified by a licensed private pool safety inspector or local council authority. Pool Safety Warehouse accepts no liability if an inspector rejects a barrier setup due to broader installation context, incorrect placement, or varying local council interpretations.

4. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law (ACL):

  • Pool Safety Warehouse shall not be held liable for any direct, indirect, incidental, or consequential damages, injuries, or losses resulting from the misuse, incorrect installation, failure to maintain, or neglect of our products.

  • Our liability is strictly limited to the replacement of the product or a refund of the purchase price in the event of a proven manufacturing defect.
